Casco Bay Legacy Charters — Terms & Conditions

By booking a charter with Casco Bay Legacy Charters, LLC (“CBLC”) you agree to the following terms and conditions. Please read them carefully before completing your reservation.
1. Reservations & Payment
A 50% deposit is required at the time of booking to secure your charter date and time. The remaining balance is due 7 days prior to your departure date. Reservations are not confirmed until the deposit is received. Failure to submit required payments may result in cancellation of your booking.
We accept all major credit cards through our secure payment processor, Stripe.
2. Cancellation & Refund Policy
Cancellations made at least 48 hours prior to your scheduled departure time are eligible for a full refund of your deposit. Cancellations made within 48 hours of departure are not guaranteed a refund and will be reviewed on a case-by-case basis taking into account operating costs incurred and the ability to rebook the charter.
3. Weather & Sea Conditions
Our vessel is a Maine-built Sabre 36 Express designed for seaworthiness and comfort in a wide range of conditions. However, weather and sea conditions along the Maine coast can change rapidly. The licensed captain retains sole authority to determine whether conditions are safe and appropriate for departure or continuation of any charter, consistent with U.S. Coast Guard regulations and insurance requirements.
If a charter is canceled prior to departure due to weather or safety concerns, guests may choose to receive a full refund of their deposit or apply the deposit toward a rescheduled charter date subject to availability.
If weather conditions deteriorate after departure, the captain may at their discretion modify the route or return to port early. If a charter is ended early due to weather or safety considerations, guests will receive a pro-rated refund for the unused portion of the charter time.
4. Passenger Limit
Per U.S. Coast Guard regulations, our vessel is licensed to carry a maximum of 6 passengers. This is a strict federal legal requirement that cannot be exceeded under any circumstances. All guests must be counted prior to boarding.
If your group arrives with more than 6 passengers you have two options:
By completing your booking you confirm that your group will not exceed 6 passengers. We strongly recommend confirming your final guest count prior to your charter date.
5. Captain’s Authority & Safety
All decisions regarding vessel operation, weather, sea conditions, route changes, departure delays or early returns are made solely by the licensed captain. These decisions are final and are made in the interest of guest safety, vessel integrity and compliance with U.S. Coast Guard regulations and insurance requirements. Guests are required to follow all safety instructions given by the captain or crew at all times.
6. Guest Conduct
Guests are expected to conduct themselves in a safe and respectful manner at all times while aboard. The captain reserves the right to return to port and end a charter without refund if any guest’s behavior poses a safety risk or is deemed disruptive or dangerous.
Alcohol may be brought aboard by guests but must be consumed responsibly. The captain reserves the right to restrict alcohol consumption if it poses a safety concern.
7. Assumption of Risk & Liability Waiver
Participating in a boat charter involves inherent risks including but not limited to rough water, adverse weather, seasickness and the general risks associated with maritime activities. By booking with Casco Bay Legacy Charters, LLC you acknowledge these risks and agree to assume full responsibility for your participation.
Casco Bay Legacy Charters, LLC, its owners, employees and contractors shall not be held liable for any injury, illness, loss or damage to persons or personal property arising from participation in a charter, except in cases of gross negligence or willful misconduct.
8. Personal Belongings
Guests are responsible for their own personal belongings at all times. Casco Bay Legacy Charters, LLC is not responsible for any lost, stolen or damaged personal property.
9. Photography & Media
Casco Bay Legacy Charters may photograph or film charters for marketing and promotional purposes. By booking you consent to the use of such images or footage. Please notify us at the time of booking if you do not wish to be photographed.
10. Governing Law
These terms and conditions are governed by the laws of the State of Maine. Any disputes arising from a booking with Casco Bay Legacy Charters, LLC shall be resolved in the courts of the State of Maine.
